Judge: Nissan must show books to IRS

Franklin-based Nissan North American has been forced to turn over contracts and letters to the Internal Revenue Service related to business conducted in Bermuda, which court documents describe as an “offshore tax haven.”

Nissan, whose global headquarters are in Japan, declined in February to release those documents because the company claimed they were “overly broad” and “not relevant to a particular tax or business matter.”

On Monday, a judge in the U.S. District Court Middle District of Tennessee ruled that Nissan would have to comply with the IRS request.

 

“We’re disappointed by the ruling but we certainly respect it and we will reply by turning over all the requested documentation,” said Nissan North America spokesman David Reuter.

According to the documents, the IRS believes Nissan moved certain business to Bermuda in order to avoid paying U.S taxes.

 

Nissan just finished a strong year, with 2010 sales up more than 26 percent.
